Medicinal Cannabis Application Process

  1. Obtain the relevant Medicinal Cannabis Business Application Forms from the Government Printery on Coronation Ave.
  1. Application Forms must be completed and submitted in both hard copy and digital format to the Office and email address of the Authority.
  1. An Application should be accompanied by a comprehensive Business Plan – detailed information could include but is not limited to:
    • Overview of the Company;
    • The medicinal cannabis business offerings the company intends to apply for;
    • Start-up finance (funding) and financial projection;
    • Products and/or Service;
    • Quality Assurance;
    • Marketing and Sales;
    • Organisation Structure;
    • Future expansion plans;
    • Business facility plans/design;
    • Land or property details including recent surveyed land drawings (signed by the surveyor);
    • Security Systemplans including surveillance cameras, 6ft fencing – razor wire at the top, concrete at the bottom etc.;
    • Inventory plans and Standard Operating Procedures;
    • Transportation Plan; and
    • Waste Management plan
    • Pest Control plan if applicable
  1. Application fees must be paid upon submission of an application. B. An application is incomplete and will not be processed by the Authority until submission of the relevant application fee in full
  2. The requisite application fee is dependent on the cannabis business offering selected by an applicant.
  1. An Application should be accompanied by Source of Funds documentation, i.e. Bank Letter referencing account holder
  1. An Application should be accompanied by Land /Property interest/ownership documentation; i.e. a Lease and Declaration of approval from the land owner, or Deed, and recent surveyed land drawings signed by a surveyor.
  1. An application should be accompanied by a Character Reference and Police Record. The Letter of Reference may be from a lawyer, Minister of Religion, or person of good standing.
  1. An application should be accompanied by two (2) government issued forms of identification-Passport, Social Security Card, Medical Benefits Card, or Voters’ Card. N.B. for non-nationals: Passport and other national ID.
  1. An application should be accompanied by the relevant Company Documents to include Certificate of Business registration, notice of Directors, etc.
  1. Upon submission of al of the aforementioned items the Application will be processed and feedback provided where necessary.
  1. If successful, a Provisional Licence will be granted to an Applicant for a period of 12 months from the day of issuance to permit build-out of the proposed facility.
  1. Provisional licences are granted with conditionalities that must be met within the twelve months period. N. B. During this period the medicinal cannabis is not allowed to trade in medicinal cannabis products.
  1. During the period of a Provisional Licence, inspections will be conducted by the Authority to ensure compliance with the Cannabis Act, 2018 and its Amendments, the Cannabis Regulations 2019, and Amendments, and the conditions under the Provisional Licence.
  1. Once all conditions have been met an Applicant will be duly notified that they are eligible for a Medicinal Cannabis Business Licence will be granted to an Applicant which is valid for two years.
  2. The applicant has thirty (30) days to pay the necessary Licence Fees before the grant of a Medicinal Cannabis Business Licence

Application Forms Required per License

  • Medicinal Cannabis Cultivation, Tier 1- Up to 5,000 square feet- (1) Form 5A, (5) Form 5B, (1) Form 6, (5) Form 7, (5) Form 8, (1) From 10, (1) Form 12, (1) Form 13 and (1) Form 14. NB: The forms that require more than 1 are specific to each owner’s information.
  • Medicinal Cannabis Research and Development – (1) Form 5A, (1) Form 6 and (1) Form 13. NB: Form 5B, 7 and 8 will be referred too from the cultivation since it is the same company applying for the license.
  • Medicinal Cannabis Transportation- (1) Form 5A, (1) Form 15 and (1) Form 16.  NB: Form 5B, 7 and 8 will be referred too from the cultivation since it is the same company applying for the license.
  • Medicinal Cannabis Dispensary- (1) Form 5A, (1) Form 6, (1) Form 10 and (1) Form 13. NB: Form 5B, 7 and 8 will be referred too from the cultivation since it is the same company applying for the license.
  • Medicinal Cannabis Infused Product Manufacturing- (1) Form 5A, (1) Form 10 and Form 13. NB: Form 5B, 7 and 8 will be referred too from the cultivation since it is the same company applying for the license.
  • Medicinal Cannabis Lounge – Form 5A,  Form 5B,  Form 6,  Form 7,  Form 8 and Form 13.
  • Medicinal Cannabis Testing Facility – Form 19,  Form 20, Form 21, Form 22, Form 23 and Form 24.
  • Medicinal Cannabis Therapeutic Centre – Form 5A,  Form 5B, Form 6, Form 7, Form 8,Form 10, Form 13.
  • Medicinal Cannabis Import/Export Licence-  Form 17  and Form 18. NB: Import and Export license are granted per transactions.
  • Medicinal Cannabis Processing and Extraction Licence – Form 5A, Form 5B, Form 6, Form 7, Form 8,  Form 13, Form 15 and Form 16.

Supporting Documents required for each form and form details.

Form 5A- Cannabis Business License Application- This form details out the business’s information. Supporting documents would be business registration from Intellectual Properties and Inland Revenue documentations.

Form 5B- Individual Occupational License Application- This form details out each owner of the business and also the employees upon hiring. The documents to support will entail: Police records, 2 reference (for owners only), source of income (for owners only), proof of address, copies of identification (passport or birth certificate and another form of government issued id).

Form 6- Premises Diagram- This form is for the lay out of the premises via a floor plan and drawing approved by DCA. The floor plan can be used by the inspection team to have an idea of what is to come and give their pre-approval. The main concern is to be able to pinpoint where the security cameras are located and also the setup of the different areas of the business operations on the property.

Form 7-Owner Submittal- The details of the owner(s).

Form 8- Financial Information Form- The owner(s) information.

Form 10-Inventory Procedure- Details of how the Inventory will be handled.

Form 12-Pest Management Plan- The procedures the company plans on using to manage pest.

Form 13- Security Procedures- The company’s security plan.

Form 14- Waste Management Plan- The way the company plans to manage its waste.

Form 15- Transportation Procedures- Company’s SOP on the transporting of Medicinal Cannabis. The Insurance form, Licensing yellow card, photos of all 4 sides of the vehicle and also a photo of the cage with lock which the cannabis or cannabis product will be stored while been transported.

Form 16- Delivery Procedures- Company’s SOP on delivering medicinal cannabis whether to patients or the dispensary.
